OFFICIAL RULES OF THE CONTEST
„DESIGN WITH A MISSION: CREATE A MODERN AND SUSTAINABLE HOLIDAY PACKAGE“

1. Organizer of the Contest and Official Rules
The contest „DESIGN WITH A MISSION: CREATE A MODERN AND SUSTAINABLE HOLIDAY PACKAGE,“ hereinafter referred to as „the Contest,“ is organized by Avendi OOD, UIC 130591250, with a registered address at 7 Iskarsko Shose Blvd., TC Europa, Building 2, Floor 2, Sofia, Bulgaria, hereinafter referred to as „the Organizer“ or „the Contest Organizer.“

Participants in the Contest are required to comply with the terms and conditions set forth in the rules outlined below, hereinafter referred to as „the Official Rules of the Contest.“ The Official Rules of the Contest will be available online at: www.avendi.bg/jwcompetition.

The Contest Organizer reserves the right to modify or supplement the Official Rules at any time, with such changes being announced on the aforementioned website.

By participating in the Contest, participants agree to be bound by these General Terms and Conditions and commit to adhering to the Contest’s rules and deadlines.

2. Contest Duration
The Contest begins on April 1, 2025 (01.04.2025). The deadline for project submissions is May 15, 2025 (15.05.2025).

The Contest is held within the territory of the Republic of Bulgaria.

The duration of the Contest may be shortened or extended beyond the initially announced deadline by decision of the Organizer, which will be published in advance on the Contest webpage: www.avendi.bg/jwcompetition.

3. Description of Prizes

The prizes that participants may win are as follows:

  • First place – BGN 5,000
  • Second place – BGN 1,500
  • Third place – BGN 500

By winning a prize, the winners acknowledge that, pursuant to the Personal Income Tax Act („PITA“) and all related provisions thereof, the Organizer is obligated to declare the awarded prize and the winners’ details to the National Revenue Agency for the relevant period and to pay the applicable tax on behalf of the winners.

4. Conditions for Participation in the Competition

The competition is held on the following website: www.avendi.bg/jwcompetition.

To participate, each entrant must submit their original design for a modern and sustainable packaging via the specially created landing page. The required file format for submission is .pdf, .zip, or .rar, with a maximum file size of 500 MB. The submitted design must correspond to the dimensions of the Johnnie Walker Black Label 700ml product, which has the following parameters:

  • Height: 28.4 cm
  • Width at the widest point: 6.8 cm

The design must demonstrate innovation, originality, and creativity, showcasing practical applicability, aesthetic appeal, and functionality.

Each participant must provide the following information when registering on the landing page:

  • First Name
  • Last Name
  • Email Address
  • Contact Phone Number

Upon entering the required details, the participant must upload their design and provide a rationale for their proposal. The proposal may be in .pdf, .zip, or .rar format, with a maximum file size of 500 MB.

  1. By participating in the competition, participants confirm their agreement with the Official Rules.
  2. By participating in the competition, participants confirm their consent for their personal data to be processed for the purposes and duration of the competition.

The competition is open to all individuals aged 18 and over who reside in the Republic of Bulgaria and meet the requirements of these Official Rules.

Each participant may enter the competition with only one design submission.

5. Evaluation Criteria

Submissions will be evaluated by a jury selected by the Organizer based on the following criteria:

  1. Innovation and Originality (30 points)
    • The extent to which the design presents innovative ideas and a unique creative approach.
    • The degree to which the proposal stands out from existing packaging on the market.
  1. Sustainability and Eco-Friendly Approach (30 points)
    • Use of environmentally friendly, recyclable, or biodegradable materials.
    • Resource optimization—minimization of waste and carbon footprint.
    • Potential for reuse or transformation of the packaging.
  1. Practical Applicability and Functionality (20 points)
    • Feasibility for large-scale production and implementation.
    • Convenience in storage, transportation, and opening.
    • Protection and preservation of the product.
  1. Aesthetic Appeal and Visual Impact (20 points)
    • Harmony between form, color, and graphic elements.
    • Alignment with the premium visual identity of Johnnie Walker Black Label.
    • Consumer appeal, particularly in the context of holiday purchases.

Evaluation will be completed within 30 business days after the competition ends.

6. Prize Collection Procedure

The winning participants will be announced on the competition’s website using anonymized data, displaying the first letter of their first and last name along with the first six digits of their phone number. Winners will also be notified via phone call and email to the contact details provided during registration.

If a winner does not respond to the Organizer via the provided phone number or email within five (5) days from the date of notification to provide additional details necessary for receiving the prize, they forfeit their right to claim the prize. In such cases, the Organizer reserves the right to allocate the prizes at its discretion.

The Organizer commits to processing the prize payment via bank transfer within 20 days of receiving the necessary details from the winners.

Each participant may enter the competition with only one design submission.

Employees of the Organizer, employees of affiliated companies, and their first and second-degree relatives (i.e., parents, children, siblings) and/or spouses are not eligible to participate in the competition.

7. Intellectual Property Rights
By participating in the Competition, participants waive all copyright and other rights over the submitted designs/projects in favor of the Organizer.
The Organizer acquires the exclusive right to use, reproduce, distribute, modify, and implement the designs/projects without time limitations and without any obligation to compensate the participants.
The participant declares that their design/project is an original work and does not infringe upon the rights of third parties.
The Organizer shall not be liable for any claims by third parties regarding copyright infringement of the submitted designs.

8. Termination of the Competition
The Organizer reserves the irrevocable right to terminate the Competition at any time by announcing such termination in accordance with Section 1, at its sole discretion or in the event of material fraud, violations of the Rules, or force majeure circumstances. In such cases, participants shall not be entitled to any compensation.
The Organizer also reserves the irrevocable right to extend the Competition period, provided that prior notice is published at www.avendi.bg/jwcompetition.

9. Limitation of Liability

By accepting these Official Rules, the Participant acknowledges that their participation in the Competition is entirely at their own risk and responsibility.

The Organizer shall not be held liable for the inability to ensure participation in the Competition due to circumstances beyond its control, including but not limited to force majeure events, unforeseen incidents, issues with the global internet network, or service disruptions beyond the Organizer’s control.

The Organizer does not guarantee that participation in the Competition will be uninterrupted, timely, secure, or error-free, as these factors are beyond its control and capacity. The Organizer shall not be liable for the loss of stored information, system failures, or technical issues related to participation in the Competition.

10. Sanctions

The Organizer has the right to immediately and without prior notice suspend or restrict a Participant’s involvement if they act in violation of the law, these Official Rules, the website’s terms of use, morality, or good conduct. This right is exercised by restricting the Participant’s access to the Competition website, removing their submitted design project, and disqualifying them from the Competition.

In such cases, the Organizer shall not be liable for any damages or lost profits suffered by the Participant or third parties as a result of the suspension or restriction of participation, removal, deletion, modification, loss, inaccuracy, or incompleteness of messages, materials, or information transmitted, used, stored, or made available through the Competition website.

If there is sufficient reason to believe that the Participant’s actions may constitute a criminal offense, the Organizer will refer the matter to the competent state authorities, providing them with all necessary information and materials to assist in identifying the perpetrator and proving the offense.

11. Indemnities

The Participant shall indemnify the Organizer and any third parties for all damages and lost profits, including paid fines, legal fees, and any incurred costs, arising from claims brought by and/or compensation paid to third parties in connection with the Participant’s involvement in the Competition. This includes violations of applicable laws, intellectual property rights, and breaches of these Official Rules and the website’s terms of use.

12. Data Protection

The Organizer is a Data Controller pursuant to the Personal Data Protection Act (PDPA).

By participating in the competition, participants acknowledge and agree that these Official Rules constitute a binding contract between each participant and the Organizer, and they fully accept the terms of participation, the rules for determining the winners, the award distribution process, and all other provisions set forth herein. At any time, a participant may terminate their participation in the competition by sending an email request for withdrawal to office@avendi.bg. The email must include the address used for registration in the competition, and upon withdrawal, the participant’s entire activity will be erased, provided they have not won a prize, thereby forfeiting their right to participate and any opportunity to win.

By entering the competition, participants declare that they are informed of their rights under the General Data Protection Regulation (GDPR), including:

  • The right to information regarding the processing of their personal data and access to the data being processed;
  • The right to correct inaccurate or incomplete data;
  • The right to request the deletion of personal data and, in cases where such data has been publicly disclosed, the right to require the Organizer to notify other data controllers of the deletion request;
  • The right to restrict the processing of personal data;
  • The right to receive their personal data in a structured, commonly used, and machine-readable format and to request the transfer of such data to another controller;
  • The right to object to data processing, requiring its cessation;
  • The right to withdraw consent at any time, thereby stopping the processing of data based on that consent, without affecting the lawfulness of processing carried out prior to withdrawal;
  • The right to lodge a complaint with the competent supervisory authority in case of suspected GDPR violations.

Participants provide the necessary personal data to take part in the competition and agree, unless otherwise specified by applicable Bulgarian and European legislation, that their data may be collected, stored, processed, and used for the following purposes:

  • Identifying individuals for valid registration, ensuring compliance with the minimum age requirement, and participation in the competition;
  • Identifying winners by requiring full name, personal identification number, address, and phone number for verification, prize collection, and compliance with legal obligations under tax and accounting regulations.

In accordance with these rules and applicable Bulgarian and European legislation, participants’ personal data may be processed and included in the databases of:
(a) The Organizer,
(b) Third parties (e.g., subcontractors),
(c) The Organizer’s business partners and contractors, and
(d) Other entities if required by law. The Organizer reserves the right to disclose participants’ personal data when legally required.

The Organizer will process personal data for the following durations:

  • For winners: Up to five (5) years after the prize is awarded, based on the Organizer’s legitimate interest (to ensure legal protection in case of claims related to awarded prizes) and in compliance with tax and accounting laws regarding tax reporting and payments on the awarded prizes, where applicable.
  • For all other participants: Up to one (1) year after the competition concludes.

By participating in the competition and accepting these Terms, each participant:
(a) Declares that they provide their own personal data during registration;
(b) Confirms that they are aware of the purposes and conditions of data processing and voluntarily provide their personal data;
(c) Expressly, voluntarily, and knowingly consents to the processing of their personal data by the Organizer and the parties mentioned herein for the specified purposes and under the outlined conditions;
(d) Expressly, voluntarily, and knowingly consents to the use of their personal data for direct marketing in accordance with these Terms;
(e) Acknowledges the right to object to the processing of their personal data for direct marketing purposes or to its disclosure to third parties by submitting a written request as described above.

By participating in the competition, participants acknowledge and understand that in the event of winning a prize, their names may be used by the Organizer in audio, video, and print materials, as well as published online, for the purpose of announcing competition results, without any financial compensation. Furthermore, participants acknowledge and accept that the Organizer or authorized representatives may contact them via the provided phone number during the competition, as well as for a period of six (6) months thereafter, and in case of disputes, until the matter is resolved.

Participants have the right to file a complaint with the Commission for Personal Data Protection (CPDP) regarding the processing of their personal data at the following address: Sofia, Prof. Tsvetan Lazarov Blvd. No. 2, or via email at kzld@cpdp.bg.

13. Other Provisions

Any written statements and communications under these Official Rules shall be considered valid if made in the form of a registered letter with return receipt, a personal message, an email, clicking a virtual button on the Organizer’s website, or similar methods, provided that the statement is technically recorded in a manner allowing for its reproduction.

If a Participant has provided an invalid email address, the statement shall be deemed received upon its dispatch by the Organizer, even if it has not actually been received.

The parties declare that if any provision of these Official Rules is found to be invalid, such invalidity shall not affect the validity of the Official Rules as a whole or any other provisions thereof. The invalid provision shall be replaced by the mandatory provisions of applicable law or established practice.

Any matters not expressly regulated by these Official Rules shall be governed by the applicable legislation of the Republic of Bulgaria.

All costs incurred by Participants in relation to their participation in the competition, such as internet access and other related expenses, shall be borne by the Participants, except for costs explicitly covered by the Organizer under these Official Rules.

All disputes between the parties shall be resolved in a spirit of mutual understanding and good faith, following the procedures outlined above. If an agreement cannot be reached, the dispute shall be referred for resolution to the competent Bulgarian court with jurisdiction in Sofia.

Participants acknowledge that any prize awarded is subject to taxation under applicable laws, and the Organizer shall take all necessary actions in accordance with the relevant legal provisions, including withholding and remitting any due taxes.

14. Official Rules

These Official Rules shall be available on the website www.avendi.bg/jwcompetition for the entire duration of the competition. By participating in the competition, participants agree to be bound by and comply with these Official Rules.

These Rules shall enter into force on April 1, 2025.
